2. Scope

By placing an order through the website, the customer agrees to be bound by these Terms & Conditions.

These Terms apply to both consumers and professional customers unless otherwise stated.

3. Products

Product descriptions, dimensions, colours, and photographs are provided as accurately as possible. Minor variations may occur due to manufacturing processes, materials, screen displays, or the handcrafted nature of certain products.

4. Orders

An order becomes binding once payment has been successfully completed and an order confirmation has been issued.

AEREA STUDIO reserves the right to refuse or cancel an order in the event of pricing errors, suspected fraud, product unavailability, or any other legitimate reason.

5. Prices and Payment

All prices displayed on the website are expressed in Euros and include VAT where applicable.

Shipping costs and any applicable taxes are displayed during checkout before the order is confirmed.

Payment must be made in full at the time of purchase.

6. Delivery

Delivery conditions, shipping estimates, customs information, returns, and refund procedures are detailed in the Shipping, Returns & Refunds page, which forms an integral part of these Terms.

7. Right of Withdrawal (B2C Consumers Only)

Consumers have the right to withdraw from their purchase within fourteen (14) days of receiving their order in accordance with applicable European consumer protection legislation.

8. Legal Warranties

Consumers benefit from the legal warranties provided under French law, including the legal warranty of conformity and the warranty against hidden defects.

These warranties apply to manufacturing defects, material defects, and products that do not conform to the order placed.

The warranties do not cover normal wear and tear, accidental damage, misuse, improper care, improper storage, impact damage, modifications, or deterioration resulting from ordinary use of the product.

9. Intellectual Property

All content available on the website, including designs, photographs, texts, graphics, trademarks, logos, product concepts, and visual elements, remains the exclusive property of AEREA STUDIO or its licensors.

No content may be reproduced, copied, distributed, modified, or used without prior written authorisation.

10. B2B Customers

The provisions relating to consumer withdrawal rights and consumer legal warranties apply only to customers acting as consumers under applicable law.

Made-to-Order Products for Business Customers

AEREA STUDIO homeware products are manufactured, assembled, or finished to order.

Orders placed by business customers for made-to-order products are firm and non-cancellable once production has commenced.

As these products are produced specifically in response to each order, they are not eligible for return, exchange, or refund except in the event of a proven manufacturing defect or non-conformity confirmed by AEREA STUDIO.

Business customers are encouraged to carefully review all specifications, dimensions, finishes, and quantities before confirming their order.

11. Limitation of Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

To the fullest extent permitted by law, AEREA STUDIO shall not be liable for indirect, incidental, or consequential losses arising from the use or purchase of its products.

For professional customers, liability shall in all cases be limited to the amount paid for the relevant order.

12. Force Majeure

AEREA STUDIO shall not be held liable for delays or failures resulting from circumstances beyond its reasonable control, including natural disasters, strikes, transport disruptions, governmental actions, supply shortages, or other force majeure events.

13. Governing Law

These Terms & Conditions are governed by French law.

Consumers may benefit from any mandatory provisions of the law of their country of residence.

Any dispute arising from these Terms shall be submitted to the competent courts in accordance with applicable legal provisions.
